Compliance with State Aid legislation

It is the responsibility of the recipient, not the Carbon Trust, to ensure that the application for funding is compliant with State Aid legislation. In the event of non-compliance the European Commission could demand that the recipient pay back all or part of the grant.

Please make sure you are satisfied that your application is compliant and seek qualified professional advice if unsure (we do not supply legal advice). Although we try our best to check all applications for compliance, we cannot accept liability for any breach.

EU Frameworks

The Applied Research scheme’s funding has been cleared as compatible with the common market, under the EU Framework for State Aid for Research & Development (96/C45/06; Notification: N706/2006).  This means it is a notified scheme and does not count towards De Minimus.

This framework was replaced from 1 January 2007 by the EU Framework for State Aid for Research & Development & Innovation (2006/C323/01). The EC's clearance of this scheme was amended to take into account the provisions of the new framework including ceasing regional bonuses (which are not available under the new framework). Applicants are also referred to the new framework, and applications should also comply with this.
